Mr. Femi Falana (SAN). Human rights lawyer said that the Lagos State government is not able to execute the General Overseer of the Christian Praying Assembly, Chukwuemeka Ezeugo aka Rev. King and others on death row.
Falana passed on the death row inmates in the senate to life imprisonment, which was said in a letter dated April 19, 2017. The said letter was addressed to Governor Ambode, highlighting that the planned implementation of death row on inmates in the state would encroach upon a existing judgement brought in 2012 by the High Court of Lagos State which ruled that it was illegal and unlawful to execute the prisoners.
He gave a reminder to the Governor in regards to the judgement of the court of the state, which was held to hang or subject the death row inmates to firing squad would result to the violation of their important right to freedom from torture assured by the Constitution.
On June 29, 2012, the ruling was delvered by Justice Mufutau Olokooba of the Lagos State High Court.
The Lagos lawyer counseled the state government to discover the only accessible choice of commuting the death penalty passed on the inmates to life imprisonment.
According to Falana, on the basis of the valid and existing judgement of the Lagos High Court on the illegality of the execution of the death penalty in Lagos State, they are urging His Excellency not to sign a death warrant authorizing the killing of any prisoners either by hanging, firing squad or any other means whatsoever.
